Terms and Conditions
Any purchase made through the website www.toolsgarage.co.uk requires the customer to read and accept these terms and conditions. By clicking to confirm the order, the customer fully accepts these terms, which are considered as the customer's "digital signature."
Purpose
These terms and conditions are designed to define the rights and obligations of the parties involved in the online sale of goods offered by THE MERCHANT to the customer.
Order Confirmation
All contractual details will be confirmed by email to the address provided by the customer during the purchasing process.
Please note that sometimes these emails may be directed to your spam or junk folder.
Proof of Transaction
Records stored in computer systems under reasonable security measures are deemed as proof of communications, orders, and payments between the parties.
Purchase orders and invoices are kept on a reliable and durable system and can be produced as evidence.
Product Information
Every effort has been made to ensure the accuracy of the information presented on the MERCHANT's website. However, THE MERCHANT or its suppliers cannot be held liable for any consequences, accidents, or special damages arising from electronic transmissions or inaccuracies in transmitted information, even if THE MERCHANT was aware of the potential for such damages.
Manufacturer and brand names are used solely for identification purposes. Product photos, descriptions, and prices are non-contractual.
Item Different from What You Ordered?
While we strive to keep product information accurate and up-to-date, please note that some products may slightly differ from the images shown.
If you believe the item received differs from what you ordered, please contact us immediately so we can assist you. Please be aware that we cannot accept returns for discrepancies in the item ordered after 14 days from the delivery date.
Validity Period of Offers and Prices
Our offers and prices are valid on the day the website is viewed and are subject to change without prior notice.
Delivery Terms
Products are delivered to the address specified by the customer on the purchase order and only to areas we service.
All products leave our premises in perfect condition. The customer must notify the carrier (or postman) of any damage (such as holes or signs of crushing) to the parcel and refuse the package if necessary. In such cases, an identical replacement will be sent to the customer at no extra charge.
No exchanges can be made after delivery if damage is not reported at the time of receipt.
As with any shipment, delays or loss of goods are possible. If you have not received the item within 7 days of shipment, please notify us immediately. The carrier will then initiate an investigation. Every effort will be made to locate the package, and if it is not found, the carrier will reimburse THE MERCHANT, who will send a replacement at no additional cost.
If you do not notify us within 7 days, we will not be held responsible for lost items.
We are not liable for delivery delays due to the carrier, adverse weather, or strikes.
Loss or Damage in Transit
THE MERCHANT is not responsible for loss or damage of goods in transit or for any discrepancies between the goods delivered and those ordered, unless the customer provides written or email notice of the issue to THE MERCHANT and the carrier within three (3) business days of delivery.
In the event of damage or discrepancies, the customer must retain the goods and make them available for inspection or collection by THE MERCHANT or its representatives upon request.
Delivery Errors
The customer must inform THE MERCHANT immediately (on the same day or, at the latest, the first business day following delivery) of any delivery error or non-conformity of goods in terms of quantity or quality, compared to the information on the purchase order.
Claims made after this time period will not be accepted.
All claims must be submitted in writing and sent to THE MERCHANT's address.
Claims that do not adhere to the above guidelines will not be accepted, and THE MERCHANT will not be held responsible.
In cases of delivery errors or exchanges, all items must be returned to THE MERCHANT in their entirety, in original packaging, and in perfect condition to THE MERCHANT’s address.
For claims to be accepted, the customer must first notify THE MERCHANT about any returns and receive consent. If accepted, the customer will return the goods to THE MERCHANT at the customer's expense.
Return shipping fees will be covered by THE MERCHANT, unless the goods do not match the original description provided by the customer.
Warranty
The provisions of these terms and conditions do not affect the customer’s right to legal warranties that require THE MERCHANT to protect the customer against latent defects in goods sold.
The customer is informed that THE MERCHANT is not the manufacturer of the goods offered on the website, and THE MERCHANT will not be held liable for defective goods.
In case of damage to property or persons due to a product defect, the product manufacturer will be held responsible. The customer should seek compensation directly from the manufacturer using the contact details provided on the product packaging.
All products sold on THE MERCHANT's website come with a one (1) year warranty. Products that have been modified or repaired by the customer or a third party not authorised by THE MERCHANT are not covered by this warranty.
For certain items still within the manufacturer’s warranty period, we may direct you to the manufacturer, who can send a technician to repair or replace the item. We can only replace such items with the manufacturer's approval.
Right of Withdrawal
Under the Distance Selling Regulations 2000, the customer has a cooling-off period of seven (7) business days from the receipt of goods, during which they can cancel the contract and return the goods at their own expense without giving a reason. All returns should be notified in advance to THE MERCHANT’s customer service team.
The cooling-off period and right to cancel do not apply to custom-made goods, downloaded products, or unsealed items such as DVDs, CDs, tapes, software, or videos.
Only complete and unused items in perfect condition for resale will be accepted. No refunds or exchanges will be given for incomplete, damaged, or unsealed items, including damage to the original packaging.
The customer may exercise this right of withdrawal without penalty, except for the return shipping fee. If the customer opts for a refund or exchange, all shipping costs are the responsibility of the customer.
If the right to withdraw is exercised, THE MERCHANT will make every effort to process the refund within 30 days.
Use of Website Content
The use of any trademarks, logos, or brand names present on the website is strictly prohibited without prior permission.
Force Majeure
Neither party will be considered in breach of its obligations due to any delay in performing or failure to perform due to causes beyond their control. A force majeure event includes, but is not limited to, unforeseen acts, events, omissions, or accidents that neither party could reasonably prevent, including strikes, lockouts, earthquakes, fires, storms, floods, lightning, explosions, or telecommunications disruptions.
In such circumstances, the delayed party must notify the other party within ten (10) business days of the event.
Unless the force majeure event persists for more than one (1) month, the parties will meet within three months to assess its impact and agree on how to proceed. The affected party may terminate the contract if the force majeure event continues beyond one (1) month.
Partial Invalidity
If any clause of these terms and conditions is deemed invalid under law or by a court decision, the remainder of the terms shall remain in force.
Non-Waiver
The failure of either party to enforce any provision of these terms or to insist upon strict adherence to any obligation shall not constitute a waiver of the party's right to require exact compliance in the future.
Data Protection
We are committed to safeguarding your privacy. Any personal information we collect will be handled in accordance with all applicable laws, including the EU General Data Protection Regulation (GDPR). By providing your personal data, you agree that we may use your information as outlined in this policy.
Applicable Law and Jurisdiction
These terms and conditions are governed by and construed in accordance with English law. All orders placed on THE MERCHANT's website are subject to acceptance of these terms.
In the event of any dispute or claim, the customer agrees to seek an amicable resolution with THE MERCHANT before initiating any legal action. Should such resolution prove impossible, any disputes relating to the sale will fall under the exclusive jurisdiction of the English courts.
